A campaign to raise funds to mount a legal challenge to the IR35 reforms which have rocked the public sector has easily passed its initial first target.
Larsen Howie reported on 26 June (see here) that Mike Gibson, a contractor who works through a personal service company named Ethical Consulting, was looking to raise around £10,500 to commence the first stage of the process.
Enough money has now been raised to conduct a research and analysis exercise to examine possible grounds for challenging the IR35 reforms.
At time of writing, the campaign has received in excess of £11,200 from 284 supporters.
Gibson cited a figure of £360,000 as being necessary to commence legal proceedings and begin a court battle. It is hoped however that if the aforementioned research proves that there are grounds for a full legal challenge, more funds can be raised and a genuine fight against the controversial reforms can take place.
“To each and every one of you who have donated to our cause - thank you from the bottom of our hearts,” Gibson wrote on the crowdfunding page he set up (see here) for his campaign. “I simply can't believe we have exceeded our total in little over one week. Our next step is to focus on the form of words that we will use to construct the brief for the barrister. The barrister will then take the brief and examine, research and analyse it to see which points give us the best opportunity to challenge IR35. I will of course keep everyone updated.
